Deemed to Comply Check

On October 2015 the Planning and Development (Local Planning Schemes) Regulations 2015 (Regulations) came into effect.  As a consequence certain types of development (e.g. a single house) do not require development approval if it fully complies with all Town Planning Scheme No. 2, and State and Local Planning Policy requirements. The requirement to obtain a building permit prior to constructing will remain unchanged.

When applying for a building permit you will be required to provide a copy of the development approval issued previously or provide confirmation from a suitably qualified person that the proposed development complies with the applicable planning legislation.

To assist with expediting the process and provide an affordable service, the City introduced a ‘Deemed-to-Comply Check’ process.  This will enable residents and developers to obtain written confirmation from the City as to whether development approval is required.

The Deemed-to-Comply Check application and fee can be submitted by the applicant to the City via email deemedtocomply@nedlands.wa.gov.au which is to include the applicable credit card details for payment of the fee, or via the post or in person.  As an alternative to providing credit card details in writing, the applicant can pay the required fee by telephoning the City on 9273 3500.

The City will provide written confirmation within 10 business days for a proposed new single dwelling and within 5 business days for other types of development (excluding grouped dwellings and multiple dwellings), as to whether development approval is required.
